NFCorp chairman strikes Shamsubahrin Ismail with a legal suit

National Feedlot Corporation Sdn Bhd (NFCorp) chairman Datuk Dr Mohamad Salleh Ismail today instituted a lawsuit against former business consultant Shamsubahrin Ismail for the frivolous and malicious statements rendered on postings on the latter’s personal Facebook account.

In his statement of claim, Datuk Dr Salleh had stated that upon Shamsubahrin being convicted and sentenced by the learned sessions court judge for cheating and money laundering offences under Section 420 of the Penal Code and Section 4 (1) of the Anti Money Laundering Act 2001 on 18 May 2015, Shamsubahrin out of anger and spite for the plaintiff engaged in a systematic campaign of malicious falsehood, slander and libel of the plaintiff with the sole purpose of injuring the reputation, character, credit and business of Datuk Dr Salleh.

The systematic campaign of malicious falsehood, slander and libel by Shamsubahrin was first made via a social media website Facebook.com on 19 May 2015 which is accessible to the general public at large, where Shamsubahrin had made defamatory remarks saying he had been made a scapegoat at the expense of an eight-year jail term.

In the FB posting Shamsubahrin had said, “Najib Razak and Macc and all its administration under Najib Razak made its clear yesterday after Datuk Shamsubahrin Ismail being made convict over its case with ex nfc boss which sharizat husband and the massage was deliver very clear that najib and its administration are protecting sharizat family on 250 million cheating case and make Shamsubahrin Ismail clear scapegoat and now shamsubahrin ismail is schedule to launch a Press Conference by wed and to open up every each story and evidence towards scapegoating him and give making salleh a free men now after shamsubahrin ismail being convict yesterday for 8 years jail term.”

Datuk Dr Salleh added that this statement by way of innuendo invariably scandalized the judiciary and government as well as the MACC, the PDRM, the attorney general and the prime minister of Malaysia to the hilt.

Shamsubahin also in another FB posting had said, “Malaysian are now must push away n made najib resign as najib n its administration are protecting sharizat n family over cheating 250 million public n give funds n najib n its administration are quitly protecting shahrizat family n close all case against sharizat family n made shaubahrin ismail a scapegoat for sharizat family.”

Despite the deplorable language demonstrated by Shamsubahrin, lawyers acting for Datuk Dr Salleh, said, “The Plaintiff avers that the impugned defamatory statements are the same in substance and meaning and thus in their natural and ordinary meaning were meant and/or were understood to mean and/or by way of innuendo bear and/or were understood to bear, among others, a derogatory image of Datuk Dr Salleh.

Datuk Dr Salleh has also applied for an injunction with a certificate of urgency against Shamsubahrin from further uttering frivolous and malicious statements against him.

Notwithstanding a conviction handed down on Shamsubahrin Ismail for five counts of cheating NFCorp’s chairman and 17 counts of money laundering, and being sentenced to eight years imprisonment and four strokes of the whip, the former business consultant had not stopped at his vexatious and malicious rants on NFCorp and its chairman.

Meanwhile, NFCorp has also initiated legal action to reclaim the RM1.75 million from the convicted business consultant for failing to deliver on his purported business consultancy services.
